GENERAL TERMS AND CONDITIONS OF SALE and DELIVERY Chacos.eu
Authentic Brands is the official distributor of Chaco in Europe and manager of this webshop.
These are the general sales and delivery conditions of Authentic Brands. Klopperman 4A, 2292 JD, Wateringen. Authentic Brands is registered with the Chamber of Commerce for The Hague under number: 70849331 and with VAT number NL858483828B01. 1.1 These general terms and conditions (“Terms”) apply to all offers and quotations of Chacos.eu and to every distance agreement concluded between Authentic Brands and a natural person (“Customer”) (“Agreement”).
1.2 By ordering, the Customer accepts the applicability of these Conditions.
1.3 Changes and additions to the provisions of these Terms and Conditions and/or further agreements only apply if they have been confirmed in writing by Chacos.eu.
2. Prices and Payment
2.1 All prices are in euros and include VAT. Shipping costs are not included in the listed prices
2.2 All prices on the website are subject to input, typing or typing errors.
No liability is accepted for the consequences of input, type or typographical errors.
2.3 Prices are not increased within the term of the agreement.
2.4 Payment for orders via the Website is made via the following payment methods:
iDeal or PayPal.
2.5 Payment of the order is made as agreed in the agreement. The order will only be shipped once the agreed (advance) payment has been made in full.
2.6 If payment is not made within 4 days of the date of order, the order will be cancelled.
2.7 If the payment term stated on the invoice is exceeded, Chacos.eu is entitled to charge the statutory interest from the end of the term without any reminder or notice of default to the Customer, plus the extrajudicial (collection) costs, the amount of which is is determined at a maximum of 15% of the outstanding amount, as well as any legal costs.
3.1 After an order has been placed, you will receive a confirmation e-mail as soon as possible. This order confirmation contains the purchase amount of your product(s) and a contribution for the shipping costs. If you have not received confirmation after placing the order, you can make this known by sending a

3.2 Delivery takes place while stocks last.
3.3 Chacos.eu is not liable for damage as a result of exceeding delivery times.
3.4 If the delivery is delayed, either due to being temporarily out of stock, or for other reasons - or if an order cannot or only partially be executed, the Customer will be notified of this.
3.5 In the context of legal rules, Chacos.eu will execute orders at least within 30 days. If this is not possible (for example, because the ordered product is not (any longer) in stock or no longer available), or there is a delay for other reasons, or an order cannot or only partially be executed, the Customer will receive month after placing the order and in that case he has the right to cancel the order without costs and notice of default.
3.6 Products are delivered to the delivery address as specified by the customer when placing the order. The risk of loss or damage to the products passes to the customer at the time the products are delivered to the customer.
3.7 If the Customer refuses or fails to take delivery of the product, Chacos.eu reserves the right to pass on the reasonable costs of storing the products to the Customer until delivery can be made. If the delivery fails for a reason beyond Chacos.eu control, Chacos.eu reserves the right to cancel the Agreement and to refund the sums paid less the reasonable costs incurred.
4. Exchange and Return
4.1 Chacos.eu allows the Customer to exchange or return (part of) the purchased products, for whatever reason, during 14 working days. This period starts to run when the ordered products are delivered. Before proceeding with the return, the customer is obliged to notify Chacos.eu in writing within the period of 7 working days after delivery and how many and which products will be returned. The Customer must prove that the delivered products have been returned on time, for example by means of proof of postal delivery. Returning the delivered products is at the expense and risk of the Customer. If the Customer has not returned the delivered products to Chacos.eu after this period, the Agreement can no longer be canceled on the basis of this article.
4.2 The shipping costs of the return shipment are for the account of the Customer, unless an error has been made by Chacos.eu. The purchase amount (and the shipping costs if an error has been made by Authentic Brands) will be refunded to the Customer's account as soon as possible, but at the latest within 30 working days. Insufficient or unstamped returns will not be accepted by Chacos.eu, regardless of the reason for the return. Unjustified returns will be returned to the Customer after deduction of the shipping costs.
4.3 The following conditions apply to exchanges and/or returns: Return of the products must be made in the original or similar solid packaging. The products must be in original condition, ie unworn, undamaged, with attached price/product tag. If these conditions are not met, the right to cancel the agreement pursuant to this article lapses.
4.4 When exchanging a defective or incorrectly delivered product, Chacos.eu will pay the shipping costs of the product to be re-sent once.
4.5 When returning, the amount to be refunded will be transferred to the Customer as soon as possible, but no later than 30 days after receipt of the return.

5. Control, Warranty and Liability
5.1 The Customer is obliged to inspect the delivered products immediately after delivery. Defects, shortcomings or missing or wrong products that the Customer has discovered or should have discovered during inspection, must be reported to Chacos.eu as soon as possible, but no later than 10 days after delivery.
5.2 Chacos.eu guarantees for 1 month that the products comply with the agreement, the specifications stated in the offer, the reasonable requirements of reliability and/or usability and the legal provisions existing on the date of the conclusion of the agreement and /or government regulations.
5.3 The aforementioned warranty does not apply if any defect has arisen as a result of improper use or if, without the prior written consent of Chacos.eu, the Customer and/or third parties have made changes or attempted to make changes to the product, the product has been used for (abnormal) purposes for which it is not intended, otherwise carelessly handled or contrary to the instructions of Chacos.eu.
5.4 The provisions of these Terms and Conditions with regard to warranty do not affect the Customer's warranty claims under the law, all with due observance of the provisions of these Terms and Conditions and the Agreement, including the nature and quality of what has been sold to the Customer. and delivered.
5.5 The Customer is obliged to give Chacos.eu the opportunity to investigate the detected defects (or have them examined). If the delivered products show defects, Chacos.eu will, at its discretion, replace or repair the delivered products free of charge or make a refund of an amount to be determined in consultation with the Customer. This amount will always be limited to a maximum of the invoice amount of the relevant product(s). Any liability of Chacos.eu for any other form of damage is excluded, including additional compensation in any form whatsoever or compensation for indirect or consequential damage.
6.1 Offers are without obligation, unless stated otherwise in the offer.
6.2 Offers from Chacos.eu do not automatically apply to repeat orders.
6.3 Chacos.eu cannot be held to its offer if the Customer should have understood that the offer, or a part thereof, contained an obvious mistake or clerical error.
7. Pictures and Specifications
7.1 All images, photos and drawings of products and data regarding, among other things, dimensions and colors on the website are shown as accurately as possible but may not be fully representative of their characteristics and may differ in color, size and be provided with optional or non-optional accessories.
